English is the official version and prevails in case of differences, subject to mandatory local law.
Scope and acceptance
These terms govern the Aki website and macOS app offered by Murilo Prataviera, an individual in Brazil. Review them before use. By using the site or app, you agree to the terms to the extent an agreement is validly formed under applicable law; if you disagree, stop using them. Mandatory consumer and privacy rights remain intact. The Privacy Policy explains data handling and is not a request for blanket consent.
Eligibility and acceptable use
You must have legal capacity or the authorization of a responsible adult where required; Aki is not directed to under-16s. Use it only on systems and data you are authorized to access. Do not use Aki for unlawful surveillance, theft of credentials, infringement, malware, harassment or bypassing security. Respect other people's privacy and intellectual property. You are responsible for reviewing captured content, choosing its destination and obtaining any required permissions for third-party data.
App, agents and third parties
Aki supplies context to the coding agent you choose; it does not guarantee that the agent's output is correct or safe. Review changes, commands and permissions before acting, and maintain backups. macOS permissions are needed for relevant features. Hosting, GitHub downloads, Sparkle updates, AI agents, payment services and external links have separate terms and policies. Their availability and conduct are outside Murilo's control. No affiliation or endorsement is implied by compatibility. Features, beta builds and updates may change or be unavailable; no support, uptime or future-feature commitment is made.
Intellectual property and license
Rights in original Aki materials belong to Murilo Prataviera or their respective owners. The app's use, copying, modification and redistribution are governed by the LICENSE supplied with your version, which prevails over these terms for software licensing. The current repository license is FSL-1.1-ALv2: permitted uses exclude defined competing uses, and each version has a future Apache-2.0 grant effective two years after it is made available, subject to the actual license text. Source visibility is not an unrestricted open-source grant. If a version has no license grant, these terms do not create one. Third-party components retain their licenses in THIRD_PARTY_NOTICES; consult the files in your distribution if repository links are unavailable. These terms do not transfer ownership of your annotations or grant rights to Aki trademarks beyond lawful identification.
Voluntary donations
A donation is voluntary support, not a purchase, subscription, investment or promise of a feature. It grants no ownership, priority support, commercial license, tax-deductibility assurance or other benefit. Aki does not receive card credentials. PayPal, Pix/Banco Inter and USDT on TRON have their own fees, terms and risks. Check amount, recipient and network before confirming; blockchain transfers may be irreversible. For an erroneous donation, contact us with a transaction reference through a private channel; recovery or refund cannot be guaranteed, without limiting mandatory rights or payment-provider remedies.
No warranty
To the fullest extent permitted by law, the website and software are provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security or uninterrupted operation. They may have defects and may lose data or capture unintended content. No assurance is made that an agent will interpret an annotation correctly. This exclusion does not remove warranties or obligations that cannot lawfully be excluded; the software license's own warranty terms also apply.
Limitation of liability
To the extent permitted by applicable law, Murilo is not liable for indirect, incidental, special or consequential losses, lost profits, business interruption or loss of data arising from the site, app or third-party services. Liability is limited only as far as the law permits. Nothing excludes liability for fraud, intentional misconduct, gross negligence or any other matter that cannot lawfully be excluded or limited, or restricts mandatory consumer remedies. No donation amount is used to override these protections.
Stopping use and changes
You may stop using Aki at any time, revoke macOS permissions and uninstall it; uninstalling may leave local data and third-party copies, as explained in the Privacy Policy. Access to hosted resources may be restricted for abuse or legal requirements. Ending use does not revoke rights already granted under an applicable software license; license termination follows that license. Updated terms will carry a new date/version, with material changes announced as appropriate. Changes do not retroactively cancel accrued rights or an existing license grant; any acceptance required by law will be obtained.
Brazilian law and disputes
Brazilian law governs these terms, subject to mandatory protections and jurisdiction rights in your country of residence. Please contact us first to try to resolve a concern; this does not restrict access to courts, regulators or consumer bodies. No compulsory arbitration, waiver of collective rights or exclusive distant forum is imposed. If a provision is unenforceable, the remainder applies to the extent lawful. The English text is the official version, subject to mandatory local language and consumer rules.
